Making Scottish charity law fair for all

The ALLIANCE has submitted a response to the Scottish Government survey on Strengthening Scottish Charity Law.
The Scottish Government launched a survey to inform its next steps in improving charity laws. The survey follows a consultation in 2019 about proposals by the Scottish Charity Regulator, OSCR. Amongst the proposals in the initial consultation were:
- Publishing annual reports and accounts in full for all charities on the Scottish Charity Register
- A power to issue positive directions to charities (e.g. to specify a positive action to protect charitable assets)
- All charities in the Scottish Charity Register to have and retain a connection in Scotland
The second survey responds to these issues in more detail.
The ALLIANCE welcomes the proposed measures in the interests of strengthening accountability, transparency and public confidence. However, legislative changes must not be unduly onerous and resource burdens should be fully considered, particularly for smaller organisations who may have less capacity to comply. There is scope to engage with charities to co-produce a system that is fair and sustainable, while progressing accountability and transparency within the sector.
